A Kenyan politician, Miguna Miguna who was standing trial for administering an oath to opposition leader, Raila Odinga who has proclaimed himself the “people’s president” of Kenya has reportedly been deported to Canada.

Mr Miguna was put into a KLM flight, according to the Daily Nation, departing Nairobi for Amsterdam on Tuesday night.

Miguna’s lawyer John Khaminwa confirmed his client’s departure from Kenya with another lawyer, Nelson Havi writing on twitter that “We are reliably informed that Miguna Miguna has been forced into a KLM flight for “deportation” to Canada. Now, how do you deport a Kenyan? This Country has been overrun by criminals.”

State prosecutors in Kenya had charged the Kenyan opposition politician with treason and unlawful assembly for his involvement in the swearing in event that took place last week.

According to the charge sheet presented in court Miguna Miguna was charged with “being present and consenting to the administration of an oath to commit a capital offence, namely treason”.

Miguna was also charged with “taking part in an unlawful assembly” and “engaging in organised criminal activity”. Critics of government have condemned the decision to deport Miguna.

The government said on Twitter that ‘‘Miguna is headed home. The court ordered he gets released and the interior ministry obeyed the orders and even assisted him with a flight ticket home’‘.

Interior ministry of Kenya has said that Mr Miguna denounced his Kenyan citizenship years back with the ministry’s spokesman Mwenda Njoka saying that “Mr Miguna denounced his Kenyan citizenship years back, acquired Canadian citizenship and never bothered to reclaim Kenyan citizenship in the legally prescribed manner neither did he disclose that he had another country’s citizenship despite being a lawyer who should have known better.”

The government of Kenya has accused the opposition leader, Raila Odinga of attempting to overthrow a legitimate regime following his inauguration last Tuesday as “people’s president”.

Despite the government describing his action as treasonable, Mr Odinga went ahead to take the oath holding a green bible at an event held at the Uhuru Park in the Kenyan capital Nairobi.

Odinga and his coalition party boycotted last year’s re-run presidential poll claiming the electoral commission failed to provide an even playing field for a free and fair election.

A court challenge to the victory of President Uhuru Kenyatta failed to succeed after the Supreme Court ruled that Kenyatta’s victory was legitimate.

President Uhuru Kenyatta was sworn in for a second term in November last year after winning the repeat presidential election held in October.
